Welcome to GifyLab ("we", "us", "our", or "Company"). These Terms of Service ("Terms") govern your access to and use of the GifyLab website, platform, and services (collectively, the "Service"). By accessing or using GifyLab, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use the Service.

2. Account Registration

To use GifyLab, you must create an account. You agree to:

• Provide accurate and complete information during registration
• Maintain the confidentiality of your account credentials
• Be responsible for all activity under your account
• Verify your email address before creating timers
• Keep your password secure and not share it with others
• Notify us immediately of any unauthorized account access

You must be at least 18 years old or the age of majority in your jurisdiction to use this Service.

You agree not to use GifyLab for any unlawful purpose or in any way that violates these Terms. Prohibited uses include:

• Sending spam or unsolicited email campaigns
• Creating timers for phishing, malware, or illegal activities
• Harassing, threatening, or abusing other users
• Attempting to gain unauthorized access to our systems
• Reverse engineering or attempting to extract our source code
• Using automated tools to access the Service (scrapers, bots)
• Violating any third-party intellectual property rights
• Creating timers with copyrighted content without permission
• Using the Service for illegal gambling, fraud, or other criminal activity
• Transmitting viruses, malware, or malicious code

We reserve the right to suspend or terminate accounts that violate this policy.

GifyLab Platform: The GifyLab platform, including all code, designs, trademarks, and content, is owned by GifyLab and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, modify, or distribute any part of the platform.

Your Content: You retain all rights to timer configurations, messages, and content you create ("User Content"). By uploading User Content, you grant GifyLab a worldwide, royalty-free license to host, display, and transmit your content for the purpose of providing the Service. You represent that you have the right to share any User Content and that it does not infringe on third-party rights.

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GIFYLAB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO GIFYLAB IN THE 12 MONTHS PRECEDING THE CLAIM.

7. Service Availability & SLA

Free Tier: We make no guarantee regarding service availability for Free tier users. The Service may be interrupted for maintenance or other reasons without notice.

Pro & Business Tiers: We aim for 99.9% uptime but do not guarantee it. Maintenance windows and force majeure events are excluded. We provide a public status page at status.gifylab.com.

8. Termination

We may suspend or terminate your account immediately if you:

• Violate these Terms or our Acceptable Use Policy
• Use the Service for illegal purposes
• Harass or abuse other users or our team
• Have repeated billing failures after a grace period
• Engage in activities that harm our platform or other users

Upon termination, your account and all associated timers will be deleted. We may retain anonymized data for legal compliance.

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. You consent to the exclusive jurisdiction of the federal and state courts located in Delaware.

11. Modifications to These Terms

We may update these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on our website. Your continued use of the Service after changes constitutes acceptance of the updated Terms. It is your responsibility to review these Terms periodically.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GifyLab regarding your use of the Service and supersede all prior agreements and understandings.
